GENERAL TERMS AND CONDITIONS

  • hereinafter referred to as "Provider" -

 

1. Scope These General Terms and Conditions (GTC) apply to all contracts for the purchase of goods, services, or other items (hereinafter "Goods") through the online store at the above URL in the version valid at the time of the conclusion of the contract. These GTC apply exclusively. Any deviating terms and conditions of the customer will not become part of the contract unless the Provider expressly agrees to them.

 

2. Conclusion of Contract

2.1 The offers in the online store constitute a non-binding invitation by the Provider for visitors to submit an offer to purchase the Goods offered in the store.

 

2.2 The ordering of Goods takes place via the Provider’s online order form. After selecting the desired Goods, entering all required information, and completing all necessary steps in the order process, the selected Goods can be ordered by clicking the order button at the end of the checkout page ("Order"). By placing an order, the customer submits a binding contractual offer to purchase the selected Goods. The contract is concluded when the Provider accepts the customer's offer. The acceptance occurs when the Provider confirms the contract in writing or text form (e.g., by email), ships the ordered Goods, or requests payment (e.g., invoice or credit card payment). The contract is deemed concluded at the time the first of these alternatives occurs.

 

2.3 Before submitting the binding order, the customer can review and correct their inputs at any time using the usual input functions. Additionally, all inputs are displayed again in a confirmation window before submitting the order and can be corrected there.

 

2.4 The Provider will store the contract text after the contract is concluded and transmit it to the customer in text form (e.g., by email). Further access to the contract text is not provided by the Provider. If the purchase was made via a customer account, the customer can view their orders and related data there.

 

2.5 The contract is available in the following languages: German, English.

 

 

3. Right of Withdrawal for Consumers Consumers generally have a right of withdrawal for contracts concluded outside business premises and for distance selling contracts. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Details can be found in the withdrawal policy provided to consumers before contract conclusion.

 

4. Payment, Default

 

4.1 The prices at the time of ordering as listed in the online store apply. All prices include the statutory VAT plus any applicable shipping costs. Available payment options are indicated in the online store.

 

4.2 If "prepayment" is agreed, the purchase price is due immediately upon contract conclusion.

 

4.3 If "SEPA direct debit" is agreed, payment is due immediately upon contract conclusion. The customer will be informed in advance when the debit will occur (pre-notification). If the direct debit fails due to insufficient funds, incorrect bank details, or other reasons attributable to the customer, the customer bears any return debit charges.

 

4.4 If payment by credit or debit card is agreed, the purchase price is due immediately upon contract conclusion.

 

4.5 If payment via "PayPal" is agreed, the purchase price is due immediately upon contract conclusion.

 

4.6 If "Sofort transfer" is agreed, the purchase price is due immediately upon contract conclusion.

 

4.7 If "Giropay" is agreed, the purchase price is due immediately upon contract conclusion.

 

5. Retention of Title The purchased Goods remain the property of the Provider until full payment has been received.

 

6. Delivery and Self-Supply Reservation

 

6.1 Unless otherwise agreed, delivery occurs within the online store’s indicated delivery time to the delivery address specified by the customer.

 

6.2 For freight shipments, delivery is made "curbside," meaning to the nearest accessible curbside of the delivery address.

 

6.3 Self-pickup of purchased Goods is excluded.

 

6.4 If the Provider cannot deliver the ordered Goods due to not being supplied without fault, despite having concluded a contract with a reliable supplier, the Provider is released from the delivery obligation and may withdraw from the contract. The Provider must inform the customer immediately of the non-availability. Any payments already made will be refunded without delay.

 

7. Warranty The statutory warranty provisions apply.

 

8. Liability and Indemnification

8.1 The Provider is fully liable for damages:

  • arising from injury to life, body, or health due to an intentional or negligent breach of duty;

  • resulting from intentional or grossly negligent breaches of duty by the Provider or its legal representatives;

  • under a warranty, if expressly agreed;

  • under mandatory liability laws (e.g., product liability law).

 

8.2 If the Provider negligently breaches a material contractual obligation, liability is limited to foreseeable damages typical for the contract, unless unlimited liability applies under section 8.1.

 

8.3 Otherwise, liability of the Provider and its representatives is excluded.

 

8.4 The customer indemnifies the Provider from any third-party claims arising from unlawful or contract-violating actions of the customer, including legal defense costs.

 

9. Data Protection The Provider treats customer personal data confidentially in accordance with legal data protection regulations. Further details can be found in the Provider’s privacy policy.

0. Final Provisions

10.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection laws dictate otherwise.

 

10.2 If the customer is a merchant, legal entity under public law, or special public law entity, the exclusive jurisdiction is at the Provider’s registered office.

 

10.3 If any provision of this contract is invalid or unenforceable, the remaining provisions remain unaffected.

 

11. Information on Online Dispute Resolution / Consumer Arbitration The EU Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr. The Provider is neither willing nor obligated to participate in dispute resolution before a consumer arbitration board.
